Conditions

This document describes the general terms and conditions of sale of RDSM nv. Orders placed by us imply an implicit consent with these conditions.

Applicability

These General Terms and Conditions of Sale apply to all our sales, works, services and deliveries to the customer, subject to changes, which both parties expressly agree in writing. Any deviations are only valid for the sales to which they relate and can not be claimed in the event of later orders. These conditions automatically take precedence over the purchase conditions of the customer. The possible nullity of one or more stipulations from these General Terms and Conditions of Sale does not affect the applicability of all other clauses.

Offers

In case of a request for a quote or quotation, indicative price estimates are given. Offers are not binding and can never give rise to an obligation to deliver to the conditions stated in the offer. Unless otherwise stated, our offers are valid for 30 days.

If the customer wishes to respond to the offer, the final invoice may deviate from the offer if additional efforts have to be made by RDSM that are not due to the usual and foreseeable circumstances or due to circumstances beyond the responsibility of RDSM.

Offers are based on the assumption that the customer is aware of the infrastructure needed to be able to use our services or products and that the customer ensures that this infrastructure is in place, works properly and - if applicable - is accessible during installation.

The agreement is only concluded when a document (such as an order form or delivery note) is signed by both parties. Every change or addition serves to be valid, confirmed in writing by the seller. All orders placed through an intermediary are only valid after they have been confirmed by the seller directly to the buyer in writing. A quotation is only valid for a specific assignment and therefore does not automatically apply to any subsequent assignments.

Price

Unless expressly stated otherwise, prices are exclusive of VAT, travel and installation costs.

Prices including travel and installation costs involve a one-off transfer and installation and can not give rise to free of charge additional movements or installations.

Payment.

Our invoices are payable in cash, unless agreed otherwise by operation of law and without notice of default. In the event of non-payment on the due date, a default interest of 12% per year will be charged. In addition, the amount of each invoice that has not been paid on the due date will be increased by 10% of such and without proof of default and this in the form of fixed compensation.

The application for judicial reorganization, suspension of payment - not even officially established - or any other fact indicating the insolvency of the buyer, means that the invoices relating to the services rendered are immediately claimable. We reserve the right in this case to cancel orders that have been made by simple notification to the buyer, without being obliged to pay any compensation.

Warranty

Unless explicitly agreed otherwise, the standard warranty for professional users is 1 year (from invoice date).

Complaints

Complaints about our deliveries are only admissible when they are formulated by registered mail within 5 days after receipt of the goods. After this period, our deliveries are considered as definitively adopted, which excludes the possibility of later complaints.

Disputes

Only the Courts of the jurisdiction of the registered office of our company are authorized to take cognizance of any dispute.

The personal data you provide via this website or our apps will be processed by RDSM. They are processed in accordance with the provisions of the European General Data Protection Regulation (GDPR) of 27 April 2016 (better known as the General Data Protection Regulation or 'GDPR').

RDSM only processes the personal data for the purpose for which they are collected and only for as long as this is necessary for this purpose. Subscriptions to newsletters are only included in the newsletters system and only for the newsletter for which registration takes place. Unsubscribe is always possible via a link in the newsletter.

Transfer to third parties

RDSM will only provide your personal data to third parties if this is necessary for the execution of an agreement with you, or to comply with a legal obligation.

Access and rights concerning personal data

You have the right to request access to your own personal data. You can request the personal data, view them and have them corrected if necessary. Automatic storage of non-personal data

During a visit to the website, data of a non-personal nature such as the browser type, the IP address, the platform and 'cookies' can be placed on the hard disk of your computer. This only happens to better tailor the website to the needs of the returning visitor.

Internet browsers allow you to prevent the use of cookies, to receive a warning when a cookie is installed or to remove the cookies from your hard drive afterwards. Consult the help function of your internet browser.

All data on surfing behavior can be converted by RDSM into anonymous statistics or log files. However, they are not analyzed on an individual or personal level under any circumstances. These data are for internal use only.

Google Analytics

We use Google Analytics to keep track of how users use the website. The information thus obtained, including the address of your computer (IP address), is transferred to and stored by Google on servers in the United States. Read Google's privacy policy for more information, as well as the specific privacy policy of Google Analytics. Google uses this information to keep track of how our website is used in order to provide us with reports about the website. Google may provide this information to third parties if Google is legally obliged to do so, or insofar as these third parties process the information on behalf of Google. We have no influence on this.

Amendments

It is possible that this Privacy Statement will be changed in the future. Our policy with regard to personal data is therefore regularly checked against the current regulations. Changes will be announced on this page.

If you subscribe to our newsletter, you will receive regular announcements from us of new products, promotions and interesting news items.

We only use your contact information for this purpose and you can at all times adjust the information we request about you.

The data will not be shared with external parties and will only be used for internal use. You can always request which data we keep from you.

Each newsletter contains a link to the unsubscribe form. You can always unsubscribe. You can always request to be completely removed from our database. If you click on a hyperlink in the newsletters sent by us, this can be logged and linked to your account. This information is only used to follow the interest in our offers internally.

The RDSM websites are protected by copyright. Nothing on our websites may be reproduced and / or made public without prior written permission from RDSM.

It is strictly forbidden to copy, redistribute, publish or modify material that is on our websites without prior written permission from RDSM. Intentional violation of copyright, which is understood to mean duplication and dissemination without the required prior consent of the creator or any rightful claimant, is considered a crime in Belgium.
